I. Introduction and Contracting Parties

1. These Terms and Conditions shall apply to all aspects of the use of the website Airnaija.com and any of its subdomains and mobile applications (the “Website”), the online betting account via the Website (the “Account”), and the gaming and gambling products and betting services operated via the Website (the “Services”).

4. The Account and any Services may be used for lawful purposes only and in a lawful manner. You must not misuse the Website by knowingly introducing viruses, trojans, or other malicious material.

5. You are solely responsible for making all arrangements necessary to have access to the Website. Airnaija cannot guarantee that the Website or any Services will be compatible with your hardware or software.

6. You are only permitted to use any software made available via the Website for the purpose of using products on the Website and for no other purposes.

7. Airnaija may suspend or terminate your Account if we reasonably believe you have breached these Terms of Use, engaged in fraudulent activity, or for any legal reason.

V. Deposits and Withdrawals

1. You can deposit funds into your Account using one of the payment methods made available by Airnaija. All payment methods must be registered in your name.

2. Your Account should not be used as a banking facility and will not generate any interest. All deposits made into the Account after the 13th of January 2025 will only be permitted to be used for betting purposes and cannot be withdrawn.

3. You may withdraw the available cash balance of your Account by making a withdrawal request to a Nigerian licensed bank account registered in your name.

4. Withdrawals are generally processed within 5 banking days, subject to any verification process.

5. You shall not attempt any charge-backs, reversals, or otherwise cancel any deposit.

6. We reserve the right to withhold payment and to declare bets void if we have reason to believe you have breached these Terms of Use.

VI. Placing Bets

1. We have no obligation to accept any bet and reserve the right to decline or limit any bet.

2. You will not be able to place a bet if you have insufficient funds in your Account. You are solely responsible for ensuring any bet placed is correct.

3. All bets are subject to a maximum pay-out limit, which is subject to change. Your bet is deemed valid only when it has been accepted by our server and appears on your Account as an "Accepted Bet."

4. You cannot cancel or change an Accepted Bet.

5. Airnaija reserves the right to withhold payment and declare a bet void if we have evidence that the integrity of an event has been questioned, prices have been manipulated, or match-rigging has taken place.

VIII. Responsible Gaming

2. We strongly suggest our Users keep gambling separate from daily activities, consider the duration of each session, and not treat gambling as an alternative source of income.

IX. Errors and Omissions

1. While Airnaija makes every effort to ensure no errors are made, human and/or system errors may occasionally occur. We reserve the right to correct any error and to void any bets placed where such an error occurred.

2. Circumstances constituting an "Error" may include, but are not limited to, palpable errors in odds, acceptance of late bets, or incorrect payment of winnings.

3. If we wrongly credit your Account, you agree to repay the amount immediately upon request.

4. You shall inform us as soon as reasonably practicable should you become aware of any Error.

X. No Warranty

1. Airnaija will endeavor to provide the Website and Services using reasonable skill and care. We make no further warranty or representation, whether express or implied.

2. No warranty is given as to the uninterrupted provision of any information, its accuracy, or the results obtained through its use.

XI. Limitations of Liability

1. Your use of the Website and any of the Services is at your sole risk.

2. Airnaija does not accept any liability for any damages, liabilities, or losses which are deemed or alleged to have arisen out of or in connection with the Website, its content, or the Services.

3. Our maximum liability to you arising out of the Terms of Use will be limited to the amount of the relevant bet or the return of misplaced funds to your Account.

XII. Intellectual Property Rights

You acknowledge and agree that all intellectual property rights in our Website, the Services, and all related data shall remain at all times vested in Airnaija or its licensors. You are permitted to use this material only as expressly authorized by us.

XIII. Complaints and Claims

1. All complaints regarding a bet must be communicated to Airnaija within 15 calendar days from the date of the settlement of the bet.

2. All claims regarding unresolved complaints must be sent in writing to Customer Services at [Airnaija Company Address, Lagos, Nigeria] within 15 calendar days from the resolution date of the complaint.

3. You acknowledge that the outcome of games shall be determined by our server records, which will be the final authority.

XIV. Waiver

If Airnaija fails to insist upon strict performance of any of your obligations, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance.

XV. Severability

If any provision of the Terms of Use is found to be invalid or unenforceable, such invalidity shall not affect the other provisions which shall remain in full force and effect.

XVI. Assignment and Transfer

You may not assign or transfer your rights and/or obligations under the Terms of Use without our prior written consent. Airnaija is entitled to assign or transfer our rights as we see fit.

XVII. Relationship and Third Party Rights

Nothing in the Terms of Use shall create or be deemed to create a partnership, joint venture, or principal-agent relationship between you and Airnaija.

XVIII. Applicable Law and Place of Jurisdiction

These Terms of Use shall be governed by and interpreted in accordance with the laws of Nigeria, and you irrevocably submit to the non-exclusive jurisdiction of the courts of Nigeria.

XIX. Entire Agreement

The Terms of Use and any document expressly referred to in them represent the entire agreement between Airnaija and the User, superseding any prior agreement, understanding, or arrangement, whether oral or in writing.
